Pavement Trips and Falls

Pavement Accident Claims are often referred to as slips and trips in a public place. If you have injured yourself as a result of an uneven or damaged pavement, you may be able to make a compensation claim.

The council is responsible for ensuring that pavements are regularly inspected and maintained in order to keep them safe. If they have failed to do so and you have sustained an injury as a result, they will be liable to pay you compensation.

Council maintenance inspection records are public documents, this way the council in question can prove they have successfully inspected a pavement. If they can do this then that will be their defence if you wish to make a claim against them. If there are inadequate or absent records that they did this then you could well be successful in your claim with Mercury Legal.

The nature of the defect in a pavement is also of paramount importance. For example, the uneven surface must be raised at least one inch from the rest of the pavement. If not, it will be extremely difficult to make a successful compensation claim.

The council has a duty to make sure the pavement is free from any dangerous materials that could result in you sustaining an injury. If you have tripped on an item that has caused you injury, you are entitled to make a pavement accident claim.
